Intellectual Property Notice

Rights to artwork remain the sole property of Jeremiah PTY LTD including after purchase. This includes the purchase of originals, commissions, prints and current and/or future reproductions of any kind. The purchase of any item, original or otherwise, does not grant the customer permission to mint the piece into an NFT, print and distribute in any form or reproduce in any way by means of profit and/or otherwise.

Collectors may not reproduce artwork in any way without express written permission from the artist. Posting images of the items purchased on social media are always welcome and does not breach this clause.



Shipping and delivery


The processing times of each item can be found within the product descriptions. Jeremiah's team is a small and dedicated to shipping your orders as soon as possible. Please note that on occasion, delays in dispatching orders may occur if artwork is going viral on social media. We apologise in advance for any inconvenience and thank you greatly for your patience.


If you need a change of address, we must be alerted within 24 hours of purchase in order to guarantee a redirect. We are unable to change the address once it has dispatched from our studio. Please contact us through the contact page as soon as possible.


Jeremiah Pty Ltd is not responsible for undelivered packages based on incorrect shipping addresses given by the customer. Please ensure that you provide the complete and correct mailing addresses at the checkout. If you desire a refund in this scenario, a restocking fee of 20% will be applied and the cost of shipping will be recovered by the studio.


Returns, Replacements and Refunds


If there is an issue with your order, we won't leave you hanging! If something has gone wrong, or your item wasn't as you were expecting - we will do everything we can to make it right. We do our best to offer colour accurate photography of the artwork, but please be mindful that calibrations often vary between devices. If colour calibrations are of concern, we recommend viewing the item from multiple devices (desktop, iPhone, etc.)

As per New Zealand's consumer protection laws, shipping fees on any and all returned items within good faith are not covered by the studio. Only faulty merchandise or products not covered under consumer guarantee will return shipment be paid by the Jeremiah Pty Ltd.

When fulfilling fine art print orders, the order invoices on paper that are wrapped around the prints are highlighted with each artwork in the parcel and marked with a different coloured highlighter if there is a misprint gift in the parcel. If you request a replacement, you must provide a photograph of the paper invoice delivered with your prints as proof of what is inside. This is simply in place to protect myself and my team from being taken advantage of.


Liability Limitation




We are not liable for goods once they are in the possession of the collector. It is not our duty to refund, exchange, replace or compensate by any means for the damage of products that have been mishandled by customers. For example: smudging fingerprints on the white border, tearing fine art prints, damaging works, etc.

As guaranteed under consumer protections, compensation for damage is due if/when damaged products are received when impacted by postal services and/or faulty merchandise has been dispatched. Every print is inspected several times before clearing quality control for shipment and only pristine purchased reproductions are packaged for you to enjoy.

Please read the product descriptions thoroughly and carefully. It is not our duty to compensate customers who do not read the information provided in the product description prior to purchase. All prints come with borders that are included in the final size of the listing.



Applicable law and jurisdiction




Unless we otherwise agree in writing, this agreement contains all the terms of our relationship and continues to apply no matter where you are located at the time any goods or services are provided to you by us and irrespective of the location where you reside.



Use of our website, supply of products or services by us to you and any other matter arising from these Terms and Conditions are subject to the laws of New Zealand. The Courts of New Zealand shall have non-exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with these terms of trade, or with the use of website or supply of any services.


Where you or any other person who you act for, or who you permit to act for you supplies incorrect information for the purchase of a product or service and we incur cost in any matter concerning that name then we may recover the costs incurred by us from you (including legal costs on a solicitor-client basis).

You agree to use our website, products and services in accordance with the applicable laws of the country or countries where your business or organisation is based.



Privacy policy and Confidentiality




Unless you opt to receive messages from us we will not contact you again in future. If you have opted to receive ongoing communications and at a later date you no longer wish to receive these communications you will be able to opt out of receiving this information by contacting us by email or by following the unsubscribe instructions at the bottom of emails sent to you.

Opting out of receiving the above mentioned messages will not prevent the sending of messages that specifically relate to your order(s).

We may use personal information that we collect about you to provide products and services to you and to administer orders and payments relating to your purchases from us.

You will need to permit us to place data files ("cookies") on your computer to enable you to use some features of some of our websites. Where you choose not to enable cookies from our Website, some functionality of those Website may not be available to you.

We may disclose your personal information as required by law.

Where you have provided information to us on a confidential basis, we will hold that information in confidence, except as required by law. We cannot guarantee that our website is secure, and we cannot be held responsible for a breach of our website security that is beyond our control.

You can request details of your personal information that we hold, and ask us to correct it, at any time.



General Conditions


We reserve the right to change these terms and conditions from time to time by notice, which may be in the form of a notice posted on our website at Jeremiahartist.co.nz.


If we fail to enforce any terms or to exercise our rights under these terms and conditions at any time, we have not waived those rights.

If any provision of these terms and conditions is held to be invalid or unenforceable for any reason, the remaining provisions shall remain in full force and effect and the parties shall adjust their respective rights and obligations in accordance with the spirit and intent of the parties as shown by these terms and conditions.

Unless any provision in this agreement expressly provides otherwise, these terms and conditions are not intended to confer a benefit on any person or class of person who is not a party to it.

We may deliver notices to you by sending them to an email address that you have notified to us.


Duties and taxes




The studio is operated in Hamilton, New Zealand and is not liable for import fees on any products purchased. This includes but is not limited to the commissioning of a custom piece, originals and fine art merchandise.

Any applicable taxes and duties are not included in the checkout total. These are determined by the customs agency in the destination country. Some countries charge import taxes while others do not. The customs agency will notify the recipient either by mail, phone, or email to pay these charges, so that the shipment can continue to its destination.

It is the responsibility of the customer to pay any duties, value added tax or other similar charges. If you refuse to pay these additional amounts, your delivery will be returned to us. Provided that the product is in its original condition, we will refund you the cost of your purchase (minus the costs of shipping to your country).

Items are declared at purchase value for exporting and under no circumstance will documents be falsified at your request.
